The Wide Diversity in the GOP’s 2014 Freshmen Class

-By Warner Todd Huston

A few days ago I noted that an American Indian got elected to the state legislature in Montana as a Republican. But the fact is, the 2014 GOP freshman field was more diverse than ever and many of those candidates won their elections. Minorities took seats as Republicans from coast to coast.

In Montana, G. Bruce Meyers, a member of the Chippewa-Cree Tribe and a Republican, took a seat in the State House and took it away from the Democrats who have held that seat for decades and decades.

But Meyers isn’t alone. A recent New York Times report notes that the GOP took control of 69 of the 99 statehouse chambers (both House and Senates) this year and many of these new and returning Republicans are minorities.

Obama Shocked by Suggestion Another Prez Might Selectively Enforce Tax Law

-By Warner Todd Huston

A recent encounter that Obama had with ABC so entirely illustrates his arrogance that it can only make you laugh. George Stephanopoulos asked Obama what would stop a future president from following his example of selectively enforcing laws by refusing to collect certain taxes. Obama was shocked, SHOCKED, I tell you, at the suggestion and told Stephanopoulos that it would be “wrong” of a president to decide not to enforce tax law.

Here was the exchange with Obama filibustering in his opening monologue:

Where is Hillary on Obama’s Abuse of Power? The Five Times She Said Presidents Need Limits

-By Warner Todd Huston

Hillary Clinton has been pretty silent over Obama’s amnesty. She has not chastised this president for his abuse of power. But this might seem to be inconsistent with her past comments because there have been at least five times when she said that our presidents need to be reigned in and have their powers limited.

Clinton railed against an overly powerful executive at least five times in the recent past. In 2006, and twice each in 2007 and 2008 Hillary warned that the US needs to restore its system of checks and balances, a system lost to an over active Chief Executive.

In 2006, for instance, Hillary attacked George W. Bush claiming that he was making “the most extraordinary claims of executive power that we’ve seen in the nation’s history.” At that time Hillary praised our constitutional democracy and urged the nation to force Bush to back off and work better with Congress.

Only months later in 2007, Clinton was again railing against the President and saying that if she were elected to the White House she would roll back Bush’s use of Executive Orders. “I think you have to restore the checks and balances and the separation of powers, which means reining in the presidency,” Clinton said to The Boston Globe.

Another Government Making it Harder for Citizens to Get Public Records

-By Warner Todd Huston

Transparency, shmansparency. Once again we see a government doing its level best to keep you, the people, from being able to find out what it is that government is doing to you. This time it is in failing Illinois where lawmakers are trying to make it much, much harder to fulfill a Freedom of Information Act (FOIA) request.

Yes, your representatives in the Illinois legislature–Republican and Democrat alike–don’t want you to be able to find out what they are doing in Springfield. Imagine that.

The bill (HB 3796) would make it extremely costly to file for an FOI request allowing the government to charge up to $100 per request and would also give the government even more time to fulfill requests for information.

Ill. Sen. Dave Syverson is an Example of Why the Ill. GOP is a Miserable Failure

-By Warner Todd Huston

Only days after the 2014 election that gave Illinois a new business-minded, tax-cutting Republican as its new Governor, Illinois State Senator and nominal Republican Dave Syverson gave us all a perfect example of why the Illinois GOP is such a crashing failure when he chirped up that he’d love to make the “temporary” state income tax hike permanent, BEFORE the new Governor even gets a chance to take office.

The 2014 midterm elections were a sharp rebuke to a nation of big spending, big government Democrats that have destroyed state budgets, the American healthcare industry, and engorged government in every corner of the nation. This wave election even affected deep blue Illinois as an insurgent first-time Republican candidate beat a thoroughly entrenched Democrat incumbent.

One of the reasons that new Illinois Governor Bruce Rauner beat Democrat Pat Quinn is because Rauner ran on his outsider status, his business acumen, and his promises to cut taxes and get the state back from the brink of collapse. Rauner promised to change the absolute fact that Illinois is the worst state in the country in every single measure of what makes a successful state.

Some State Democrats Abandoning Party, Switching to Republican

-By Warner Todd Huston

Thus far at least four Democrats have already jumped the sinking Democrat ship to become Republicans and in one case it gave the GOP a majority control of a state senate since the 1930s.

The first to jump parties was West Virginia State Senator Daniel Hall. The Wyoming County Senator announced the day after the midterm elections that he was switching his party affiliation from Democrat to Republican because, he said, most of his constituents are Republican and he felt he wasn’t serving their interests as a Democrat.

The WV senate was split 17-17 and Hall’s jump gave the WV GOP control of the state senate for the first time since the 1930s.

Obamacare Voters & Gang of Eight Immigration Senators Saw Big Losses on Tuesday

-By Warner Todd Huston

If you are a US Senator that supported Obamacare and/or one who supported the vaunted “Gang of Eight” senators who were seeking immigration compromise you are preparing for a long retirement back home in most cases because voters threw you out on your ear.

All these Democrats have been sacrificed on the altar of Obama.

First of all, you’ll recall that back in 2013 a group of eight US Senators got together supposedly to buck the gridlock and come to a compromise on immigration. The media loved these guys and hailed them as all that is good about Washington.

Hilarious: Hillary Sings Praises of Possible 2016 Rival, Socialist Elizabeth Warren

-By Warner Todd Huston

Hillary Clinton and Massachusetts Senator Elizabeth Warren, both rumored to be in the hunt for the 2016 Democrat nomination for President, appeared at the same event last week prompting Clinton to praise Warren as a “passionate champion for working people.”

As one of the nation’s most well known Democrat women, Hillary Clinton is certainly expected to throw her hat in the ring for the 2016 Democrat nomination for President. But there is another up-and-coming woman of the (far, far) left who is dallying with the same decision. Senator Elizabeth Warren has slowly begun to soften her stance against running going from a solid “no” to a “we’ll see what happens.”

In April, Warren had told ABC that she was absolutely not running for president. But by October her stance had softened considerably.

In a recent interview with People magazine, Warren said that she has learned not to “be so sure what lies ahead.” This is quite a difference from her previous straight out statement of “I’m not running for president.”

Congress Mulling Mandatory Isolation for Returning Ebola Doctors

-By Warner Todd Huston

After a doctor returning from treating patients in West Africa was diagnosed with the deadly Ebola virus, some in Congress are proposing that any healthcare worker returning from overseas after treating Ebola patients must be placed in isolation to make sure they are free of the disease.

Doctor Craig Spencer was diagnosed with Ebola upon returning to the US after taking care of Ebola patients in Guinea but when he first came home he was not exhibiting any symptoms. But only days after his return Spencer checked into Bellevue Hospital in New York and in short order was diagnosed with the virus.

The doctor is now in isolation and being treated for Ebola.

Before he began showing symptoms, Dr. Spencer was carrying on his life as normal, riding city mass transit, eating out, even going bowling. This is something that has alarmed lawmakers sparking a motion to make isolation mandatory.

MEDIA BIAS ALERT: Deadspin Pushes False Story Saying Colorado GOP Sen. Candidate Cory Gardner Lied About School Football Career

-By Warner Todd Huston

The left was super, super excited to find out that Deaspin.com discovered that Cory Gardner, the Republican candidate for senate in Colorado, lied about playing football for his high school football team in the 1980s. The left went wild pushing the Deadspin.com story until… well, until the Deadspin story turned out to be false in every way.

Gardner is currently a Congressman in the Centennial State but he decided to run against incumbent Colorado Senator Mark Udall–a Democrat. At first the left didn’t worry over much about Gardner because they assumed he couldn’t beat the long time incumbent Democrat. But recently Gardner has surged ahead of Udall in the polls, seriously worrying the left.

Sen. Durbin’s Wife A Lobbyist Who ‘Accidentally’ Got High Dollar Federal Contracts

-By Warner Todd Huston

Illinois Senior Senator, Democrat Dick Durbin was forced to respond to a Chicago Tribune story that revealed that his wife is a lobbyist who received high-dollar federal contracts. Durbin said it was purely coincidental… then offered to sell us the Brooklyn Bridge.

Durbin told the Tribune that his wife only lobbies with the State of Illinois, not the federal government, so the millions she rakes in from federal contracts is just a coincidence. Really. It was… a totally, unseen, completely accidental coincidence… that a Senator who is the third in line of power in the US Senate has a wife who just coincidentally got millions in federal contracts.

Republican Leaders Pushing Wealth Redistribution

-By Warner Todd Huston

Traditionally, Republicans are supposed to be against the redistribution of wealth in the USA. But it seems times may be changing with at least three purportedly conservative leaders in Congress suddenly advocating for at least some income redistribution.

According to Fortune magazine three major congressional Republican leaders are floating plans that call for some sort of redistribution.

Republican Senators Mike Lee and Marco Rubio have recently proposed what they are calling a pro-family and pro-growth tax reform plan that would refigure tax rates from the current seven brackets to only two; 15 and 35 percent.

Ted Cruz Does Right–Walks Out on Mid Eastern Scumbags Claiming to be Christians

-By Warner Todd Huston

Texas Senator Ted Cruz had a bit of a problem yesterday when it became an issue that he had agreed to speak before a so-called Christian group made up of Lebanese and Palestinian Christians. But when he announced his support of Israel before these “Christians” they booed him and he saved his reputation by walking out on them in the middle of his address.

The problem for Cruz was that he agreed to speak before the non-profit group In Defense of Christians. The problem wasn’t that Cruz was speaking before a group that seeks to support Christians in the Middle East, but that he chose to speak before a group of people many of whom support Hamas and Hezbollah and people who oppose Israel… yes, even though they claim to be Christians.

This was a strange move by Cruz, strange that he’d chose to go before this group of terror lovers. But he really saved his own reputation by what he did there.

Cities That Have Used Military Equipment for Riot Control Might Owe Feds Millions

-By Warner Todd Huston

On Tuesday, Obama administration officials testified that local police who received surplus military equipment from a government program were never supposed to use that equipment for riot control and if the items were misused, cities may be forced to repay millions in grants given them by the government to purchase the equipment.

The testimony was delivered before Congress by members of the Defense and Homeland Security departments on Tuesday afternoon in a hearing that was spurred by shocking images from Ferguson, Missouri where police used a variety of military-styled equipment to quell rioting last month. Local police obtained some of that surplus military equipment through the Pentagon’s 1033 Program.

During the hearing Senators pointed out that many departments have been given equipment that they really have no legitimate need for. During the hearing it was revealed that one small Oklahoma county sheriff’s department for instance, received two 18-ton MRAP armored vehicles even though the department has only one full-time peace officer.

Several Senators questioned just why local police need military equipment at all. Kentucky Sen. Rand Paul noted that 12,000 bayonets have been given out to local police and he wondered why a weapon of war like that, one used solely for killing and not peacekeeping, needed to be placed in the hands of a police department.

We Should Not Call Them The ‘Ruling Class,’ But the ‘Immunes’

-by Warner Todd Huston

In the bad old days when Kings reigned and the various classes of royalty vied for position the only danger for the “ruling class” was the fear that another member of their class might strike a blow against them. Unlike the lower classes, the rulers of antiquity were immune from the vagaries of life and out of reach of the law. In fact, there was no law. Unfortunately, we are headed right back in that scheme of life.

But one of the societal schemes that the founders of our country set about the task of destroying was that of the divine right of kings, the idea that royalty is subject to no earthly authority.

The founders wanted to create a society that allowed for social mobility among all citizens. They wanted a meritocracy where people could get ahead from the result of their own work and abilities. Above all they wanted a stable rule of law so that such stability could fuel growth.

For nearly 200 years their model worked admirably. But thanks to the drive toward communism starting at the end of the 1800s it appears that the founders’ societal invention has been destroyed.

The question for today is this: are we are living at the end of the American way of life? Has it been destroyed so badly that it is unable to be returned with the mere election of new leaders?

Dem Chair Says Obama ‘Doing His Job Less Often’ Than Any Prez Since Cleveland?

Once again we see how stupid Democrat Party Chair Debbie Wasserman Schultz is with a clumsy comment filled with false implications and absurd assumptions not to mention unintentional hilarity as this fool proclaims that Obama has done his job “less often” than any president since Grover Cleveland.

In an appearance on the odious and bottom rated MSNBC, Wasserman Schultz made this messy verbal blunder which in itself is pretty amusing. But underlying her garbled, inarticulate point is a base assumption that proves the lies that Democrats promulgate of what constitutes a president’s job.

Now Destroying Unions is the Same as Reforming Government

-By Warner Todd Huston

Years ago folks that stood against unions always had that one obstacle of “private” concerns in the way of urging people away from unionism. But today, with most unions being tied directly to government, now fighting unions is an act of beneficial government reform.

Once upon a time, the biggest hurdle for those arguing against unionism was the simple truth–and it was a truth–that unions and businesses were private concerns and if the two entities agreed to co-exist, who was an anti-union activist to say anything against the arrangement?

This is a simple, logical question that always made anti-union activists look like meddling outsiders. And the truth is, no matter how right they were that unionism is a bad idea for everyone, they were meddlers!

But today we have a far different situation for those who stand against unions. Since 1959 when unions were first allowed to organize government workers unions have slowly encroached into nearly every aspect of government causing spending to soar, bloating pensions beyond belief, and destroying the efficiency of government.

With Thad Cochran it’s Time to Think Long Term About Destroying the GOP

-By Warner Todd Huston

The tea party movement is often accused of not thinking long term. In many cases this is probably a true accusation because most tea partiers think an election is a goal in and of itself. But with the underhanded, anti-conservative, un-American tactics of the GOP establishment that gave Thad Cochran a primary win in Mississippi, it is obviously time for the tea party to start planning the destruction of the GOP establishment.

Thad Cochran and his patrons allied with former Mississippi Governor Haley Barbour did not run an honorable campaign. In the waning days of their campaign it was their strategy to lie about conservatives, throw the race card and scare vulnerable black voters with tales that the KKK would swoop down upon them if Cochran’s tea party opponent won the primary, dole out cash to voters for their vote, and tell them Cochran would increase free food stamps for them if they crossed over and voted in the GOP primary.

In short Haley Barbour and the senile Cochran perpetrated every low down, Democrat-styled trick to destroy a true conservative candidate just so they could remain in power. These so-called Republicans purposefully disenfranchised tens of thousands of Republican voters.

SCOTUS Unanimously Slaps Down Obama on Recess Appointments

-By Warner Todd Huston

This one is pretty amazing. The US Supreme Court has delivered a unanimous slap to the President saying that his recess appointments were illicit. Even the court’s liberals said Obama was wrong on this.

If you are out of the loop, here is what happened: Obama wanted to make some extremely partisan appointments to the National Labor Relations board (NLRB) so that he could deliver even more pro union decisions in the disputes between labor and businesses that the NLRB is set up to adjudicate.

The U.S. Senate did not like his choices because the folks Obama wanted to appoint were obvious union shills that would further erode the NLRB’s status as an unbiased arbitrator between labor unions and the business sector (as it is supposed to be).

Illinois One of the Worst GDP Growth in Entire Midwest

-By Warner Todd Huston

Illinois has earned its spot as the state with the worst GDP in the entire Midwest. So, once again we find that Illinois turns out to be one of the worst states in the country for nearly any and every metric that makes a successful state.

Michael Lucci of the Illinois Policy Institute pointed out in a recent blog post that Illinois ranks only above Missouri as the worst for GDP growth among the 12 Midwestern states in the survey.

“Illinois recorded the second-worst growth in gross domestic product of any state in the Midwest,” Lucci wrote, “according to this week’s release from the Bureau of Economic Analysis. The Illinois economy grew by just 0.9 percent in 2013. Only Missouri grew slower, at a sluggish 0.8 percent.”

Leftist Donna Brazile Warns The GOP Civil War is Over, The Tea Party Won

-by Warner Todd Huston

Old Clinton hack Donna Brazile has a message for her readers: the GOP civil war is over and the Tea Party won. While Brazile is usually fully expected to be typically and wholly wrong in her left-wing proclamations and while asking a liberal what is going on with conservatives is usually a waste of time, like the stopped clock, Brazile got this one more or less right.

Brazile piece written her piece for CNN notes that the whole of Washington was surprised by GOP strongman Eric Cantor’s primary loss and is shocked that he will not be returning to Congress even as he thought he was headed to a big primary win and looking forward to more and more power if not the Speaker’s chair itself.

After chronicling Cantor’s loss Brazile also touched on the run off that establishment Republican Thad Cochran has been reduced to in Mississippi and pointed out that Senate Majority leader Mitch McConnell only won his own primary in Kentucky by edging closer to Tea Party principles during his campaign.

Mmmmm History: Hillary Extols Abe Lincoln’s Senate Career (Hint He Was Never a Senator)

Hillary Clinton is an Illinois girl, right? Oh, and Hillary Clinton is the smartest woman in the world, isn’t she? Then how come she thinks Abraham Lincoln got elected to the Senate before he became President, when he never did?

Hillary was in Chicago for a meaningless, love-fest appearance with former Obama White House Chief of Staff and current Chicago Mayor Rahm Emanuel where both professed a deep love and respect for each other but otherwise offered nothing of substance to their audience. But during this schmaltzy blubber fest Clinton waxed historical for the crowd.

New IRS Obamacare Rule Guarantees Massive Job Loss

-By Warner Todd Huston

For the last two years many businesses have been warning that because Obamacare will hurt them so badly they will cease offering employees healthcare and dump employees onto the Obamacare exchanges. But now the IRS has ruled that business will not be allowed to do this and this move guarantees that companies will begin a massive wave of layoffs to make up the costs.

An article in The New York Times relays the bad news to employers that no matter what they thought they were going to do, they are stuck with the massive new costs of Obamacare and they won’t be able to escape that massive tax increase by just closing out their healthcare benefits.

“Many employers,” the Times reported on May 25,”had concluded that it would be cheaper to provide each employee with a lump sum of money to buy insurance on an exchange, instead of providing coverage directly.”

Liberal Columnist: Anti-Black Racism Used Against Bill Clinton, Too

-By Warner Todd Huston

Proof that liberals can see racism everywhere they look, a liberal columnist has written a piece saying that Obama isn’t the only President that white racists attacked. They “racialized” Bill Clinton, too.

On May 8, one of The Atlantic’s race-centric writers, Ta-Nehisi Coates, felt the need to disagree with another writer for his publication by insisting that, just as the do Obama, white racists did, indeed, attack Clinton with their bigoted antics

Coates was responding to The Atlantic’s Peter Beinart who wrote a May 2 piece reminding readers that “not all Republican opposition to Obama is racist.”

Beinart summed up the feelings of liberals well saying that today they feel both frustrated and liberated at the same time.

Mass. Democrat Says Gov’t Should Control Media

-By Warner Todd Huston

That darned old media is just out of control and filled with “hate crimes,” Senator Ed Markey (D, Mass.) says. So, he thinks the best solution is that government should control everything we see and hear. What could go wrong with that, Mr. Orwell?

Markey has proposed a tax dollar-wasting “study” to find ways to force broadcast media from showing “hate crimes” to we stupid, uneducated Americans. Markey is here to save us from ourselves, you see.

As to that whole First Amendment, freedom of speech thing? Markey doesn’t see any reason why that should be a problem. Why? Well, he doesn’t really say, but just take his word for it, won’t you? He should change his name from Markey to Malarkey.

Of course, not everyone is hailing Malarkey’s idea as such a great idea. Gene Policinski, who works at the First Amendment Center, says that this is something we’d better notice. “Anytime government in any form or level looks to study our speech–even something that we might all consider detestable speech–we need to pay attention.”

Under Obamacare, Healthcare Costs Soar & Obama’s $40 Million Vacation Tab

-By Warner Todd Huston

Remember how our liar in chief said that under his all powerful Obamacare law medical costs would go down? That apparently was the next lie of the year after his lie that we could all keep our doctors and insurance if we liked it as spending on healthcare exploded in the first Obamacare quarter and it’s now higher than ever.

The Bureau of Economic Analysis has released a new report that shows that healthcare spending grew 9.9 percent as Obamacare takes effect.

“It’s the biggest percent change in health-care spending since 1980, when health-care spending jumped 10% in the third quarter,” Business Insider reports. “Analysts said it’s primarily due to a consumption boost from the implementation of the Affordable Care Act. Adjusted for inflation, America is spending more on health care than ever before.”

Meanwhile the price of fixing the catastrophically failed Obamacare website has passed $121 million tax dollars.

“There doesn’t seem to be a light at the end of the tunnel for Obamacare website expenses,” said Rep. Darrell E. Issa (R, CA), House Oversight and Government Reform Committee Chairman.

Poll: Even People in Illinois Say Illinois Worst State to Live In

-By Warner Todd Huston

Now, usually when a state is dissed it is dissed by people from outside the state. With the usual hometown bravado, and all, denizens of a state used to stick up for their own in the face of criticism. But a new poll finds that Illinois is so bad, even people that live there say it sucks.

America is a land of polls, for sure, but this poll is a particularly telling one. The Gallup polling firm asked residents of the 50 states (or the 57 states if you are our clueless President) what they thought about their own home states. It turns out that Montanans really love their state. But Illinois and Rhode Island? Not so much.

The top five states where residents are happy to live right where they are living are Montana (77% of residents love the place), Alaska (also 77%), Utah (70%), Wyoming (69%), and Texas (68%).

Further, if you ask everyone the general question of where the best place to live is, Texas wins, followed by Alaska then Hawaii.

Clinton Papers: Bill and Hillary Feared the Internet

-By Warner Todd Huston

The Clinton Library has released over 7,000 pages of documents from Bill’s presidency, likely hoping that what ever is in them will be “old news” by the time Hillary announces her bid for president. But one of the documents is very interesting and shows that Bill and Hillary really feared and hated the free flow of information on the Internet.

A report, titled “Communication Stream of Conspiracy Commerce,” was meant to “prove” Hillary’s claim that a “vast right wing conspiracy” was trying to destroy her and Bill. It also made to explain “the Internet influence.”

In 1998, Hillary appeared on NBC’s Today Show and said that a “vast right wing conspiracy” had been trying to destroy her husband “since the day he announced for president.”

Of course, her absurd claim became the joke of the decade and for years afterward conservatives were proud to belong to that “vast right win conspiracy.” The phrase became such a joke, though, that Clinton’s White House decided it had to “prove” the claim with a report linking that “conspiracy” all together.

2014 Illinois Tea Party Tax Day Tea Party Rally in St. Charles

-By Warner Todd Huston

The Illinois Tea Party (illinoisteaparty.net) held its sixth annual Chicago Tax Day Tea Party rally, but this year without the “Chicago” part as the group held their rally in the western suburbs. Specifically, the event was held in the Arcadia Theater in St. Charles where some 300 participants attended to hear candidates for office, activists, and patriotic music.

The April 15 rally targeted Obamacare and Senator Dick Durbin, of course, but mentions of the Illinois Republican Party, Sec. of Treasury candidate and establishment GOPer Tom Cross, and Senator Mark Kirk drew as many boos as the Democrats showing that grass roots conservatives have about had it with the feckless, powerless Illinois GOP.

Head of the Illinois Tea Party Denise Cattoni

Not all elected Republicans were opposed, though. One of the very first speakers introduced by Ill. Tea Party chief Denise Cattoni was State Rep. Jeanne Ives of Wheaton. Ives, while not a dynamic speaker, had a great five-minute speech written up with her key point being that she was going to be troublesome to the state Republican Party. “I will continue to be troublesome, just as troublesome as possible in Springfield,” she said warming to her theme.

State Rep. Jeanne Ives

The first speaker was State Senator Jim Oberweis, who went on first so he could get to a fundraiser.

Candidate for U.S. Senate Jim Oberweis

Oberweis is running as an admitted “underdog” to ultra left-wing Senator Dick Durbin. Obie, as his supporters affectionately dub him, noted that we need to stop the extremism in Washington and made to whip the audience up to dump Durbin by having them repeat, “Millionaire. Writer Huston: Long Road Ahead for GM, But Don’t Count It Out

-By Warner Todd Huston

So, I was on Newsmax TV on Tuesday…

From the Newsmax website:

It will take a long time for General Motors to regain its reputation as a trusted carmaker — but don’t count it out, says Warner Todd Huston, a writer for Wizbang and Breitbart.com.

“Thirteen people killed tied to this [ignition] faulty switch and GM people running for cover,” Huston told Ed Berliner, guest host of “The Steve Malzberg Show” on Newsmax TV.

“But . . . America loves to give people a second act. I wouldn’t count anybody down for the count. [The Rev.] Al Sharpton has been able to make a new living,” Huston said Tuesday.

Since February, GM has recalled 2.6 million vehicles with faulty ignition switches that could cause the engine to turn off and disable the power steering and airbags.

Asked whether the massive recall was a result of negligence on the part of GM, Huston said:

“There’s probably some [who were] saying, no, we’ll fix it later, others that are trying to avoid being held accountable, so, they try to push it off in the background,” he said.

“It’s a mixture of things. I don’t think it’s just . . . negligence, but it’s definitely negligence.”
