President Obama’s new approach to cybersecurity likely is more of an Internet game-changer than many appreciate. Initial reporting and commentary has been superficial and has not connected dots or analyzed the broader logical implications of this new policy emphasis and trajectory.

Why is it a game-changer for the Internet?

  • First, it formalizes a new leading priority for the Internet.
  • Second, it formalizes the lack of cybersecurity as the Internet’s leading problem.
  • Third, it practically redefines what “open Internet” means.
  • Fourth, it practically takes any extreme form of net neutrality off the table.

Moreover, the new cybersecurity focus will likely have a practical effect on the trajectory of Internet 3.0, which embodies cloud computing (where security has not been a primary priority by many); the Mobile web (where security has always been a very high priority); and the Internet of Things (where security will be imperative to prevent theft, intrusion, and sabotage).

Corruption Scandal in Mass. State House… Name That Party

It’s been a little while since we had a good “Name that Party” story, but leave it to corruption plagued Democrats and their willing accomplices in the Old Media to always find some time in their busy schedules to give us an opportunity to play our favorite game. This time it is a former Speaker of the House in Massachusetts who, along with a cadre of his pals, was indicted on corruption charges. Naturally, the party affiliation is mysteriously absent from many of the stories.

It seems that ex-Speaker Salvatore F. DiMasi, who resigned from the House back in January at the outset of this scandal, and three “Beacon Hill power brokers” have been indicted on corruption charges involving mishandled software contracts. Of course, DiMasi is a leading Democrat in the state, but you sure wouldn’t know that from any of the reports.

Teachers Union Up In Arms About… Smoking?

As America’s dumbest generation gets dumber, teachers unions stand as an important stepping stone to educating our youth. Unfortunately, the stepping stones that the unions represent are paving a road to ruin as opposed to one of success. Still, one teachers union in Pennsylvania has used its power to great effect. Sadly, the effect is not one that has anything to do with education. On the bright side, though, at least it is an issue of reinforcing personal liberty.

It seems that Pennsylvania’s colleges and universities decided to ban smoking everywhere on campuses across the Keystone State. Pursuant to that, rules were made and students and teachers alike were told to leave their butts home, no smoking allowed.

The schools made one tiny miscalculation, though. They imagined that the unions would meekly agree to this universal ban and say nothing forcing teachers to stop smoking on the job. The schools were wrong.

EC declares “no need for State intervention” in broadband duopoly

…because there’s no market failure

In a significant blow to U.S. advocates of Government-mandated open access networks — over facilities-based broadband network competition — the European Commission (EC) just declared “no need for State intervention” in geographic zones where there are at least two facilities-based broadband network competitors, because that means “there is no market failure.”

The EC made the declaration in its just-released report: “Community Guidelines for the application of State aid rules in relation to rapid deployment of broadband networks.” This is the EC guidance for spending economic stimulus funds for promoting broadband.

Ark. Killing of Soldiers Shows Why Terror Isn’t a Police Matter

The heinous act of Abdulhakim Mujahid Muhammad, 24, formerly Carlos Leon Bledsoe, a prison convert to Islam, is a perfect example of why terrorism cannot be fought using police procedures and is more effectively fought under military auspices. The fact that Muhammad was under FBI surveillance and already under suspicion of possible terrorist activities but got away with murdering one soldier and seriously injuring another is a lesson of how police procedures are prone to failure in stopping terrorism.

Many on the left in America lambasted President Bush for utilizing military tribunals and for his contention that the capture of foreign terrorists was a military matter. They said that these terrorist’s “civil rights” were being violated by the quick military actions and they abhorred the limited availability to legal council such procedures offered to suspects. The solution the left commonly offers is for the full American justice system to be placed at the disposal of foreign terror suspects. The left claims that doing so makes our own actions “consistent” with our traditions of justice.

This little report is interesting in a few ways, but the most important is that it seems to show that the publishers of at least one American newspaper are wholly ignorant of American history. It seems that early last week the Warren Times Observer of Warren, Pennsylvania published an ad that basically expressed a desire to see President Barack Obama assassinated and they didn’t even know it.

The small town paper published an ad that read as follows: “May Obama follow in the steps of Lincoln, Garfield, McKinley and Kennedy!” Sadly, the paper’s editors completely missed the salient fact that all these historical presidents — except for Obama — were assassinated in office!

Hope and Mirrors: Stimulus ‘Saved’ Cops To Be Fired Anyway

On March 6, Obama’s mouthpiece, Robert Gibbs, happily told the nation that the Obama “stimulus” plan had saved the jobs of 25 Cops in Columbus, Ohio. This was an example, Gibbs trumpeted, of how Obama’s supposed stimulus package was “working” to set the country to rights. President Obama and Attorney General Eric Holder even took a road trip to Columbus to proudly see these “saved” cops being sworn in as police officers.

It was back slaps and grins all around as Obama celebrated his successful “stimulus” program. That was less than two months ago. Today, those same 25 new policemen whose jobs were “saved” by the great father in Washington have been laid off over lack of funds.

Obama’s great hope and mirrors campaign strikes its false stance as savior again, proving that there was no “stimulus” in the stimulus plan and that it was a false front all along meant only to serve as a part of Obama’s permanent political campaign effort. In reality, there’s just no there, there.

This is the Fourth slight made against England by the Obama administration and it is beginning to look less and less like an accident and more like a purposeful policy of snubbing the Brits. I mean, imagine. Planning a D-Day commemoration that excludes the Queen! And she is the only world leader that actually served during the war, on top of it.

A few of our newly minted spokesmen for all those seemingly ubiquitous new Republican moderates out there are starting to say that if we oppose Sotomayor, we do so at our own risk. By this they mean that if we are seen to oppose a strong Hispanic woman we will be hurting our chances further with Hispanic voters. To this one can only say poppycock. Sotomayor should be opposed and vigorously but not because of anything other than her rather un-judicial judicial philosophy.

No one, not one conservative commentator or politician, cares a whit that Sotomayor is Hispanic. There simply is no expectation of opposing her because she is of Latino heritage. And so, because of this, there should be no reason whatever to shy from criticizing her qualifications and philosophy. Further, to allow moderates on our side or anyone on the left to equate our opposition to a racial objection is illegitimate and should be vociferously denied.

Misleading ‘Study’ Slams Anti-Union Forces

A group called the Economic Policy Institute is touting a paper by Cornell professor Kate Bronfenbrenner who claims to be investigating anti-union forces that she says are growing in intensity, boldness, and power. Bronfenbrenner writes that between 1999 and 2003 employer resistance to union organizing has increased causing unionizing efforts to fail despite what she claims is an increase in the public’s desire to see more union success. But it seems that there are some problems with her methodology: she never talked to anyone but disgruntled union organizers to gather her material.

Bronfenbrenner is concerned that there is mounting efforts in the business community to oppose union organizing and sets out to prove her theory. She investigates several unionizing efforts that failed and compiles some stats on such efforts. But, her facts are self-fulfilling her premise in that the percentage of failed union attempts seem to be higher than the average for National Labor Relations Board elections during the targeted years of study. The latest data from the OECD and other sources indicate that the U.S. is no longer falling behind the rest of the world in broadband.

These latest data are relevant to assumptions underlying the FCC’s National Broadband Strategy due to Congress next February and also to broadband policymakers’ interest in more data-driven policymaking.

In particular, the OECD broadband rankings have been prominently cited by some as important evidence to justify a reversal of current facilities-based broadband competition policy, in favor of a more government-centered broadband policy.

A federal judge in Manhattan sentenced former President of the New York City Central Labor Council (CLC), Brian M. McLaughlin (who was also part of the AFL-CIO), to 10 years in prison for fraud, embezzlement and corruption charges this week.

The 57-year-old McLaughlin was also a low-level New York City Assemblyman from Queens whose power came from his close ties to the labor union. He “pleaded guilty in March 2008 to racketeering charges that included using embezzlement, fraud and bribes to take money from taxpayers, labor unions and contractors, even from a Little League team in Queens,” reported The New York Times.

International Busy Body Laws Waning?

Are we beginning to see the first cracks in the idea of “universal jurisdiction,” the international busy body “law” that said that any nation can arrest the leaders of any other nation and try them for “war crimes”? Let us hope we are, at least.

Now, I’ve always contended that the Nuremberg trials of Nazi war criminals was a mistake. Not because those Nazi scum were innocent, far from it. But, rather, because it set a bad precedent that contended that the “international community” was qualified to capture, prosecute, and punish “war criminals.” This entire concept is made to order if one wants to destroy national sovereignty but not for one much interested in the rule of law. In fact, it is a direct assault on any rule of law because it invites the capricious rule of the mob (by reflecting current world opinion) on just who is and who is not a “war criminal.” Not to mention that the assumption that a world body can make these determinations must as a matter of course preclude any power over its own people by the individual nations involved. The determination of the “world community” will and must supersede national legal rulings — unless those rulings happen to agree with that world opinion which only makes the national decision at best perfunctory and certainly pointless.

Illinois: New Gov. Same Old Garbage

A Pandering, Union suck-up that wants to soak the rich. Is this guy any different than the last guy?

Did you know that unless we pass Replacement Governor Pat Quinn’s union appeasing, pension stuffing budget, Illinois prison doors will be opened for a flood of dangerous criminals to walk free? Did you know that the old and infirm will be left to die in the streets? Did you know that all our teachers will be sent home never to teach again? The busses will stop, health care will end, local governments will lose state aid, locusts will descend from the skies, we will find our skin erupting in boils and disease will plague the state? Did you know it’s doomsday?

Well if you didn’t, Replacement Governor Quinn has been so kind as to have informed us all of the pending doom to the state of Illinois unless he gets his way. Quinn issued his “doomsday budget” warning at an address made yesterday at Chicago’s City Club, a downtown civic organization popular as a platform for city and state politicians to issue political pronouncements. Sadly, the Replacement Governor’s doomsaying is no different than the previous criminal governor we had that did the same thing. It is little else but scare tactics designed to force the legislature to bend to his will.

Green Follies: Gov’t Built Solar House Falls Apart

Hailed as a completely self-sustaining building, the solar house at the Troy Community Center in Troy, Michigan was set to open for tours and community use this Summer. Unfortunately, the systems failed to work over the winter, pipes froze, and water burst through the uninhabited structure causing the floors to collapse. As a result, the building sits unused after the hundreds of thousands of dollars wasted on it by government.

This is government waste and folly at it worst, but it is typical of the best government can do. Oh, it’s not the best because anything worked, it’s the best because failure is all one can expect from government when undertaking projects of this nature.

The model house was supposed to be an engineering marvel that would save the planet. But ended up being just a monstrous waste of the taxpayer’s money.

AFL-CIO Uses Bulgarian Website to Advocate for Congress to Act on EFCA

What, there aren’t any websites run by American workers and hosted in the USA that the AFL-CIO’s Building and Construction Trades Department could find to host its press releases? Apparently not as far as the union is concerned, anyway, because a press release to push a Washington conference in support of the Employee Free Choice Act (EFCA) is hosted on PR-USA.net, a misleadingly named site hosted and run in Varna, Bulgaria and registered by one Mr. Dobri Bojilov .

Another amusing aspect of this choice for a site host is the fact that the conference is discussing the issue of H2(b) visa reform. Of course, the H2(b) visa is the the work visa offered to foreign workers by the U.S. government. So, this union is using a foreign website to advocate against the importation of foreign workers. This union is using a foreign run site to advocate for American workers.

Why is the AFL-CIO using a foreign web service to host its press releases? Don’t they care about American workers?

I wonder if the AFL-CIO can spell hypocrisy?

Lanny Davis Wants it both ways: truth commissions without the truth commissions

In a recent Washington Times editorial, former Clinton Special Council Lanny Davis has decided that former vp Dick Cheney should be brought up on charges even though he has formerly spoken against such prosecutions. Why the sudden flip flop? Apparently his only reason is that Cheney has had the audacity to appear on a few TV talk shows to defend himself.

It is somewhat ironic that Davis, with Clinton a man that appeared all over TV during the Lewinski scandal to defend themselves, is upset that Cheney is appearing all over TV to defend himself. But the sad thing is that Davis has had to twist himself into a pretzel to excuse his revenge against Cheney. Davis’ legal logic leaves quite a bit to be desired with this about face.

Why the Australian “Fiber Mae” Broadband Model Doesn’t Work for the U.S.

As the FCC lays the groundwork for its submission of a National Broadband Strategy to Congress next February, some suggest the U.S. follow the lead of Australia’s new broadband policy model. While it may have superficial and nostalgic appeal to some, upon close scrutiny and analysis it is not an applicable, practical nor sound broadband policy option for the United States for a variety of reasons. The Australian “Fiber Mae” broadband policy model is:

  • Not applicable to the U.S. because the ownership and competitive baselines in Australia and the U.S. are not analogous;
  • Not practical for the U.S. because it is a hugely expensive proposal in an exceedingly tight budget/financial environment that would generate very little incremental additional benefit over the current competitive trajectory; and
  • Not sound policy for the U.S. because it pursues the wrong policy emphasis and structure, which could have the perverse result of the U.S. falling behind in broadband leadership — the exact opposite of the intended result.

By way of background, the Australian government announced last month that it would establish “a new company to build and operate a new super-fast National Broadband Network.” The proposal would deploy fiber to the home to 90% of users with 100 Mbs, and deploy 12 Mbs wireless technology to the remaining 10% of the country, at an estimated total cost of ~$31b or ~$4,100 per home passed. This government-sponsored enterprise would be majority-owned by the Australian government. It would create “Australia’s first national wholesale only, open access broadband network.”

Fake ‘Comments’ Supporting EFCA Posted All Over the Web

Recently, an effort to post all across the web fake comments supporting a key union cause has been discovered. In Internet activist talk, this is called “astroturfing.” The term describes a campaign of fake comments posted on multiple websites where articles are discussing any particular issue about which the “astroturfers” want to have their position known. In this case the issue is the discussion of the woefully misnamed Employee Free Choice Act (EFCA) and the “astroturfing” is an effort by union supporters to explain away the dangers this act represents to the American worker. The end result is supposed to be that when regular web users come to a page and see the pro-union message they imagine it to be from a “real” visitor. In truth it is an organized campaign to spam comments sections with a canned comment misleading readers into thinking “real people” support the position being “astroturfed.” (i.e., since astroturf is fake grass, this laying on of a fake “covering” explains the reference)

A website named The Truth About the EFCA, discovered the astroturfing effort in the form of the exact same comments in favor of the EFCA on at least three different sites posted under three different names. The site was alerted to this fact because its own site was one of the astroturfed sites.

The piece has several links to other articles in it, but the main point is about the overgenerous and unfunded pension plans that unions all across the country have been foolishly allowed to negotiate. These pensions are simply untenable and always were but most businesses and unions kept kicking this can down the road until it is finally hit a dead end.

In keeping with the America denigrating tone set by president Obama, the U.S. Ambassador to the U.N., Susan Rice, told participants of the United Nations Human Rights Council that the U.S. has “not been perfect ourselves” on human rights issues.

Rice was discussing the pending membership of the United States on the U.N. Human Rights Council which has such human rights loving states as China, Cuba, Saudi Arabia, Jordon, Nicaragua, Egypt, and Pakistan as members. With members of such high standards, it is no wonder that Ambassador Rice felt the need to apologize for the U.S.A.

Union Local’s Sham Expenditures? $93,755 on ‘Computer Services’?

Larry Seale of First Transit Employee Rights Blog found an odd expenditure for Los Angeles based Amalgamated Transit Union (ATU) Local 1277 early this month. The vexing question here is why would a Local union office need to spend $93,755 on “computer services”? What are they doing, rebuilding flight control for NASA?

On the Local’s LM-2 form, a financial disclosure form required by the federal government, the payout of “computer services” is listed as having been paid to a Doc Fixit, Inc of Santa Clarita, California. $93,755 is an awful lot of money for ”computer services” unless one was fitting an entire TV station, or starting up a printing company or some such major effort. But for sure that sort of money should be thought far and above what might be needed for a simple union Local’s offices.

Seale got curious when he saw the generous expenditure and tried to look up this Doc Fixit, Inc but couldn’t find a listing for it anywhere. It’s as if no such company exists. So where did this money go? What did it buy the Local? And where is this mysterious Doc Fixit, Inc computer company?

Something seems pretty fishy in L.A., doesn’t it?

Some may look at Obama’s defense funding request coming in at about $144.6 billion as a welcome reduction over the 2008 budget of $186 billion. Some may also be tempted to claim that Obama is ramping down America’s war efforts. But that would be a hasty conclusion because the numbers are a bit deceiving. On top of that some of the areas that Obama wants to shift the money to shows that the president is heading down the wrong path to a successful conclusion of our Iraq/Afghanistan conflicts and that he is perhaps foolishly expecting Pakistan to follow his lead when it is already plain that she won’t, maybe even can’t.
