How FCC Regulation Would Change the Internet

The FCC’s claims that their proposed net neutrality regulations would just “preserve” the open Internet are simply not true. The facts clearly state that the FCC’s proposed regulations would: Be a big change in FCC Internet policy; Implement big Internet policy changes without Congressional authorization; and Change the Internet in big ways. (The one-page PDF version of this post is here)

The FCC’s proposed net neutrality regs are a big change in FCC Internet policy; they would:

  • Replace the FCC’s voluntary net neutrality guidelines with mandated net neutrality regulations;
  • Selectively apply net neutrality regulations to only broadband and not to applications/content providers like the current principles do;
  • Add two completely new net neutrality principles that are not found in law or congressional policy:
  • Mandate the strictest non-discrimination requirement in the last 75 years;
  • Mandate public disclosure of detailed proprietary network management techniques for the first time;
  • Expand application of net neutrality to wireless and satellite broadband for the very first time;
  • Expand consumers access to content entitlement by adding entitlement to send/distribute content as well;
  • Redefine entitlement to competition in the current fourth principle, to favor resale competition over facilities-based competition;
  • Subject broadband companies to a new “Mother-may-I” FCC approval process for offering new managed services and for experimenting with new business models; and
  • Subordinate private standard-setting bodies, like the IETF, to new FCC omni-technical oversight/approval.

House to Vote This Weekend?

Apparently, Speaker Pelosi is getting a bit concerned that this healthcare fight is getting out of her control (do ya think?) and she wants to force a vote through this Saturday.

For his part, Rep. Mike Pence (R-Ind.) says, HR 3962 is a “freight train of runaway federal spending, bloated bureaucracy, mandates and higher taxes.”

Pence is correct that the iron boot of Obama’s government will come down on the necks of each and every citizen if these mandates and this government intervention comes to pass. Obamacare will make healthcare more expensive, harder to get, and of lesser quality. In truth, there is no other possible outcome as has been seen in every country that has tried it already.

On Thursday, I introduced the Medical Rights and Reform Act (H.R. 3970) – a centrist alternative for health care reform that lowers costs and expands coverage without raising taxes.

When Speaker Pelosi unveiled the final version of her government health care bill (H.R. 3962), she told us it cost less than $900 billion. Hours later, the Congressional Budget Office reported the bill would actually cost $1.05 trillion.

Late last week, in the dead of night. President Obama made an unannounced trip to Dover, Delaware, where he was photographed saluting some flag-covered coffins that were coming in from Afghanistan. There were about 18 coffins on this day. And afterwards, Obama said that this experience “would influence his decision” on troop levels and future policies in the war in that Afghanistan.

Well, first I fault the press. I’ve been saying for years that facts on war casualties, in Iraq, Afghanistan, or wherever, is defective. The national importance of casualties should be gauged by relative casualties in other, American wars. It’s called context. It is especially important in public issues involving deaths of Americans.

Is a disease or condition that kills ten children a year as worthy of public attention and millions of dollars of spending as a another disease that kills a thousand children a year? Put the question that way, and any sensible citizen or sensible politician will say, of course not. The focus and the spending should go where it will save the most lives, do the most good.

But that sort of question cannot be answered without the comparative statistics. Few things matter in the abstract. It is only when put in context that the importance of most fact can be weighed. By and large, the American press does not put death stories – civilian or military – in comparative context.

SPN 2009 Conference: Final Day

The Wednesday session began with a breakfast address by James K. Glassman the former Under Secretary for Public Diplomacy and Public Affairs, U.S. Dept. of State during the George W. Bush administration. He spoke on Internet freedom (as opposed to net neutrality) and expressed his hope that a thousand Internet flowers would bloom without onerous regulation squelching it all. (I’ll add some photos later once I return home. All the camera stuff is packed up for the trip home at his time)

Mr. Glassman is about to begin his new role as the executive director of the forthcoming George W. Bush Institute to be housed in Dallas, Texas at the soon to be built G.W. Bush library.

I asked him if he could keep in mind the danger that state taxation presents to the Internet and urged him not just to focus on the federal threat that the Obama administration is presenting at this time. He agreed and I am hopeful that this subject will form a part of his future strategy.

SPN 2009 Conference: Final Day”


The 17th Annual State Policy Network Conference

The first half of this week I’ll be attending the State Policy Network’s annual meeting, this year in Asheville, North Carolina. It is being held at The Gove, a fantastic (and huge) hotel/resort complex here in the beautiful North Carolina hills.

I will be attending all sorts of interesting seminars on the New Media, organizing, funding, etc. It’s a pretty jam packed schedule, so I am not sure how much time I will have for reporting back.

The Gove is a testament to American can-do spirit that has been stifled by government today. This humongous complex was built by a family in a years time with the aide of one steam shovel and a crew of men with mules, pulleys, and ropes.

In any case, I hope to get back to the hotel here and write a bit about the first day later tonight.

Utopia or Dystopian Nightmare?

Sometimes I worry that our country will become more like the former Soviet Union. Americans will wait in lines for hours in order to receive bread for the week. I wonder what it would be like to run out of toilet paper and not be able to run to the store to stock up on what I grew up believing were necessities. Mostly, I am angered that I am living paycheck to paycheck…tethered to a house not worth the mortgage I own, unable to advance my earning potential because there is no free money for a middle aged white person who gives one third of her income back to the government to be spent on programs with which I don’t agree and from which I receive no benefit. However, I must pick my battles when addressing an issue with which I’m concerned because I know the majority of folks in the blue state in which I reside and work dismiss my speculation as the ranting of a lunatic or someone who can’t get with the program; embrace “change”.

Today, I read how our government has set aside a multi-million dollar technology fund for Islamic countries. Our education system would thrive if that kind of money could be used to provide free online courses to adults wanting to earn a terminal degree or specialize in a shortage area. Instead, tuition goes up, taxes go to fund free money for those who qualify for the Pell grants which will supplement the cost of a college education, and more and more graduates (and many who won’t graduate) will leave their post-secondary experience with an accumulated debt that will make it even more impossible to chase the elusive American dream. Many will not find jobs that require their advanced education.

For Constitution Day this year at Sacramento City College Associated Student Government (ASG) President and student Steve Macias arranged for a group named Genocide Awareness Project, an anti-abortion group, to participate on campus in the Constitution Day activities.

The group was approved for participation by the ASG and set up its booth at the appointed time. And then the world came to an end. Pro-Infanticide groups such as Planned Parenthood set up their own, countering booths the next day and left-wing hatemongers in the student body immediately began to circulate a recall petition to have Mr. Macias removed from the Associated Student Government leadership.

There is also some speculation that this insane, un-American recall effort being visited upon Mr. Macias is being tacitly approved of by the College adviser overseeing the ASG.

Gov. Pawlenty Goes Off on Obamacare

Minnesota Governor Tim Pawlenty delivered a red meat assessment of Obamacare and it appears he doesn’t like it much. Pawlenty slammed Obamacare as a “bait-and-switch” and said the president is “corrosive to freedom and liberty.”

In a NewsMax interview, Pawlenty really went after Obama serving a hearty dish of red meat to conservative voters across the country. Gov. Pawlenty is widely considered a prime candidate for president in 2012.

Pawlenty calls President Obama a “movement liberal” and says he’s “projecting potential weakness” to the world with his foreign policies.

“His solutions are federalization of policy, spending way beyond anything we’ve seen in terms of deficit or debt levels, spending the country into bankruptcy,” Pawlenty says. “And what’s behind it is a philosophy that government knows best, a nanny-state mentality on domestic issues that will ultimately be corrosive to the other pillars of our country — to markets, private enterprise, individual responsibility, freedom and liberty.”

As to Obamacare, Pawlenty calls it a bait-and-switch.

House Speaker Lacks Democrat Votes for ‘Public Option’

Despite assurances to the contrary, Politico.com is reporting that Speaker of the House Nancy Pelosi (D, Calif.) does not have the votes to include the so-called public option in the House version of Obamacare making it more likely that a “trigger” will be included instead.

Politico also reports that Obama himself announced support for the trigger option.

Obama told Senate Democratic leadership at the White House Thursday evening that his preference is for the trigger championed by Sen. Olympia Snowe (R-Maine) — a plan that would allow a public plan to kick in if private insurers don’t expand coverage fast enough, a top administration official told POLITICO. It’s also sign Obama is interested in maintaining a sense of bipartisanship around the health reform plan.

Regardless of the Politco report, however, Speaker Pelosi came out today in a press conference and insisted that the public option will, indeed, be in the bill.

Whatever the final outcome will be, however, this shows that Speaker Pelosi is having trouble manhandling her caucus. This also means that voters still have a chance to affect this vote by calling their representatives and urging them to oppose the public option.

Senate Defeats Dem Leader Reid’s ‘Doc Fix’ Plan

Roll Call is reporting that the $250 billion extension to the Medicare physician payment program was defeated in the Senate today. Reid couldn’t even get a simple majority losing in a 47 to 53 vote.

Naturally Democrat Majority Leader Harry Reid (Nev) blames the Republicans. Reid complained that the loss was a result of “activities and actions by the Republican-dominated Washington.” Seriously. A “Republican dominated Washington”? Did Harry Reid miss the fact that the Democrats have majorities in both the House and the Senate as well as holding the White House? How could Washington be “Republican dominated” when the GOP has little capability to affect the debate through the power of majority control?

Roll Call pinpoints the most salient question here, though. If Reid can’t even get this one through with a Democrat majority how is he going to get the rest of Obamacare passed? The GOP, for its part, was ecstatic.

Institute for Truth in Accounting: Chicago TV on Illinois Budget Woes

Sheila Weinberg, Institute for Truth in Accounting founder & CEO, joined WTTW-TV’s Chicago Tonight reporter Elizabeth Bracken on an October 15th panel to discuss the proposed 2011 $32 billion budget, which includes a possible $12 billion deficit. When asked about the exact size of Illinois budget shortfall, Ms. Weinberg stated, “There are a lot of numbers floating around.We want transparency, and they want to continue the accounting gimmicks. “One gimmick identified is when the state “borrows $2 billion and then claims it as revenues.”

Ms. Weinberg’s recommendation is for Illinois to switch from cash based to FACT based, or accrual accounting methods. “Cash based accounting worked when Illinois was each year paying for current services, but when longer-term services such as government employee pensions were added, the accounting became an absolute mess.”

UN Says Gender ‘Not Fixed,’ Is ‘Changeable’

UN “Special Rapporteur” Martin Scheinin recently filed a report with the UN titled “Protection of Human Rights and Fundamental Freedoms While Countering Terrorism” in which he states that human gender is not a fixed thing but a mere “social construct” that is “changeable over time.”

In this paper Scheinin, the “Special Rapporteur” — I do get a kick out of the pretentiousness of that grandiose title — and the UN leadership (a word I use advisedly) wants terribly to deny both genetics and simple reality. Page eight of this report asserts that a man is not necessarily a man and a women… well, maybe she’s something else entirely… but what ever they are their gender is but a temporary designation determined at the whim of society.

Obamacare Lacks ‘Protection Against Treatment Denials’

The L.A. Times published a story that was probably meant solely as a bash on insurance companies, but still the report brings up several issues that Obamacare will only make worse if passed. The problem raised in the headline, “Healthcare bills lack protections against treatment denials, experts say,” isn’t the only problem the story touches upon — not that the L.A. Times dwells on them.

The headline problem is important, of course though the Times tries to phrase the problem as an evil failing of insurance companies. The fact is it is really but a common-sense inevitability. The Times reports that Obamacare will force an increase in denials of services to patients because of cost overruns.

Union Plans Voted Down by Home Healthcare Workers

If CBS News has it right, the majority of in-home healthcare workers in Illinois voted not to join a union despite the Service Employees International Union (SEIU) and Governor Quinn’s best efforts to force the issue.

Earlier in the year, Governor Quinn signed Executive Order 09-15 that gave away the private information of every in-home healthcare worker in the state to several unions so that they might begin a campaign to cajole these workers into joining a union by calling them on the phone and visiting them at their homes.

In-home healthcare workers receive a stipend from the state in order to help them care for developmentally disabled or medically at risk family members.

Obama Abandons Abused Women in Afghanistan

President Barack Obama is putting the finishing touches on making a mockery out of the unsupportable claim that Democrats care about women’s rights by his signal to the Afghan Taliban, warlords, strongmen, militias, and tribal leaders that he’s ready to negotiate with anyone there in order to smooth his efforts in that troubled region.

President Obama is letting it be known that he’s prepared to cut deals with the Taliban in order for Afghan warlords to cut ties with al Qaeda. Obama thinks he can work with the supposedly “moderate” Taliban groups in Afghanistan in a bid to oust al Qaeda. A Taliban moderate. What sort of mythical creature is this?

One thing is sure, however, if Obama turns Afghanistan back over to the Taliban and other Islamic warlords in an effort to make it appear as if he’s had success there, women will be the hardest hit. The possibility that Obama will abandon Afghanistan’s women frightens Wazhma Frogh, an Afghan women’s advocate who received the U.S. State Department’s 2009 International Woman of Courage Award.

1). Congress will pass a Health Insurance Reform Act and within three years after its passage, all existing health insurance providers will be replaced by a government controlled health insurance program. The elite media will applaud this reality and explain that this outcome was inevitable because the majority of Americans lack sufficient education and initiative to resolve this issue on their own. The people will therefore gratefully accept the supreme wisdom of Congress with feeble complaint and the politicians will find it convenient to ignore any questions requiring an intelligent response.

2). The war in Afghanistan will continue without the addition of an adequate number of U.S. troops because the inner conscience of one who won the 2009 Nobel Peace Prize for indecisively allowing the war to continue indefinitely, is honor bound to remain indecisive as long as it takes.

CNN: ‘Disingenuous Insurance Companies’ or Disingenuous Reporting?

On October 13 CNN’s John Roberts conducted an interview with purported “insurance industry insider” Wendell Potter who claimed that the disingenuous actions of the insurance industry made him “decide to become a critic of the industry.”

Mr. Potter is a former head of Public Relations of the CIGNA Corp and Humana, Inc. but he is more than that, not that John Roberts told his viewers this fact. The first major problem with this interview is that Wendell Potter is now a member of Center for Media and Democracy, a group funded by the left-wing Tides Foundation (itself supported by George Soros) and other left-wing organizations. The only hint that viewers got of this affiliation was a three second caption at the bottom of the screen. Roberts never verbally identified the group to which Potter belongs nor that its agenda was anti-insurance company.

Potter went on to rail against the insurance companies calling them disingenuous with their dealings with Obama and Congress.

I think the industry has been disingenuous from the beginning of this debate. They have never had any intention of being good faith partners with the president and Congress. And I know this from having been a part of many, many efforts over the past 20 years, almost, to defeat reform, or to help shape reform to the industry’s benefit. And I was a part of some of the efforts to plan this very campaign.

Roberts, of course, did not challenge this assertion.

CNN: ‘Disingenuous Insurance Companies’ or Disingenuous Reporting?”


Healthcare Conference Call With Representatives Shadegg and Rodgers

Today at 4:30PM eastern a blogger conference call was held by Representatives John Shadegg (R, AZ) and Cathy McMorris Rodgers (R, WA). The subject we spoke about was that of House Republican’s ideas and problems on healthcare reform issues in both the Senate and the House. The following are my notes of the call, any direct quotes are in quote marks but the rest is my summation of what was said.

The call opened with a welcome from Cathy McMorris Rodgers who introduced herself and Rep. Shadegg. Rodgers talked of the situation in the House and reminded us that 44 House Democrats said they’d vote no on the bill if it has public option and 57 said they’ll vote no if it doesn’t have the public option so the Democrats might not have the votes to pass H.B. 3200.

Shadegg reminded us that the CBO score on the Senate bill was made on 10 years of taxes being taken by the federal government but with only 7 years of coverage afforded, so it’s no wonder the bill sounds like it is paid for. Shadegg also warned of the political monkeying that is going on with the Baucus bill in the Senate. He mentioned that Harry Reid is down in the polls back home so he tried to slip through a sleight of hand way for four favored states to get special Medicaid provisions (including Nev., Oregon, Mich.) forcing the other 46 states to pick up the tab. This was Reid’s attempt to find success in his upcoming elections in Nevada.

Colin Hanna of Let Freedom Ring joined Neil Cavuto on his Fox News show earlier this week to talk of his new effort, wethepeoplecanread.com. This effort is echoing that being made by Representatives like Joe Wilson and his comrades in trying to get a 72 hour period where the healthcare bill will be posted online for everyone to read before Congress gets to vote on it.

Hanna told Cavuto that there is news that Senate Majority Leader Harry Reid intends to sneak the Senate’s healthcare proposals in as an amendment to an unrelated House tax bill so that it will bypass the debating process.

Reports are that Reid plans to attach the Senate’s entire healthcare bill as an amendment to H.R. 1586, a bill passed by the House back in March that imposes a 90 percent tax on bonuses paid to employees of certain bailed-out financial institutions.

Canadians Talk About Their Nationalized Healthcare

The Mackinac Center has produced a video filled with Canadians warning us that their vaunted nationalized healthcare system, the one Barack Obama keeps pointing to as a model for us, is not all it’s claimed to be.

The MC took its cameras throughout Canada and asked Canadians what they thought of their nationalized, socialistic healthcare system and what they thought of the push in the United States to create its own copy of their system. Almost to a person they warned us against it and each worried that they themselves would lose one of their own healthcare benefits: American medicine used when their system fails them.

The Mackinac Center for Public Policy is a free market think tank in Michigan.

The Old Media wholly ignored the story, but one of the extremists that Barack Obama appointed as a so-called czar in his government had to step down when the full extent of his un-American radicalism was exposed on the Internet. Obama’s “green czar,” Van Jones, resigned when it was revealed how anti-American his rhetoric was not to mention his membership in a Marxist organization. But Van Jones isn’t the only far leftist that Obama has tried to foist on this country in places of influence.

We’ve been hearing lately about the radical homosexual agenda of Obama’s “safe schools czar,” Kevin Jennings. When he was a school teacher, Jennings once admittedly abetted a sexual relationship between a teenage male student of his and an adult man. He did not report this molestation, but smiled and advised the poor kid to “use a condom.”

Maine, Tennessee, Massachusetts Universal Healthcare Plans a Bust

Both President Obama and the Democratic Congress have ignored the mess that three states have made of their economy and tax burden by attempting to create a public option and/or universal healthcare. Tennessee has its TennCare program, Maine has tried a “public option” program, and Massachusetts has its RomenyCare system that promises healthcare for all. Each of them has been a boondoggle for the taxpayers and has failed to deliver promised savings and enhanced coverage.

In fact, each of these states have begun to cut services to people because the costs have skyrocketed despite claims that “savings” would occur and that everyone would get more coverage.

Last week, the Wall Street Journal had a piece by Wendy Williams saying that the “fines” Massachusetts imposed on people who ostensibly didn’t have insurance coverage — an idea that Obama wants included in his Obamacare policies — now falls even on people with insurance in the Bay State.

Initially this fine imposed by the Mass. legislature was supposed to force people to get healthcare insurance. But “without informing anyone” the legislature decided just getting insurance wasn’t good enough. To avoid the fine now Mass. residents have to get the kind of insurance of which the government approves.

The Obama Justice Department’s Secret Blogging Team… Is it Illegal?

Obama’s Attorney General, Eric Holder, has apparently hired a cadre of left-wing, Democrat campaign bloggers to troll through the Internet looking for news stories and blog posts that denigrate the Obama agenda. After such websites are found it is the job of these secret lefty bloggers to leave comments that come to the support of Obamaism in the comments sections. It seems that Eric Holder has created his own little propaganda unit in a valiant effort to become the Bloggi Riefenstahl of the Obama era.

As reported at The Muffled Oar, a blog that first broke the story of Holder’s secretive blogging unit — dubbed the “Blog Squad” by blogger Isaac Muzzey — Holder has housed this unit in the Office of Public Affairs at the Department of Justice. It also appears that former John Edwards staffer Tracy Russo is part of this special unit.

A site called whorunsgov.com reported back in May that DOJ hired Russo to do “media outreach for the whole department.” It is, according to whorunsgov.com, the first time such an effort has been made at DOJ.

The Only Real Strategy for Afghanistan

There has been quite a bit of criticism directed at President Obama for his handling – or mishandling – of the Afghan theater in the global conflict with radical Islamists. To be certain, it should be the number one or, at the very least, number two item on his list of priorities. That it is not is deserving of criticism. But the catalyst for this dysfunctional thinking emanates from the reality that we, as a nation, don’t have a proper understanding of the conflict at hand and, therefore, have very different opinions – some based in fact but most influenced by ideology – as to the consequences of implementing the wrong strategy.

During the 2008 presidential campaign, then candidate Barack Obama identified the Afghan theater as the only “legitimate” military theater in which the US military was engaged. He did so in a politicized attempt to paint the Iraqi theater as illegitimate; an optional battle theater championed by his opponent. Whether or not you agree with that belief is irrelevant to the fact that Mr. Obama identified the Afghan theater as being “the good war.” This declaration, along with his promise to support the generals on the ground, intimated that he was going to respect the judgments and opinions of the field commanders with regard to strategy and assessment. That understood, it really shouldn’t be too much for the American people to expect their president to follow through on his campaign promises.

The Enemy

Ongoing military campaign aside, we have never really accurately profiled the enemy and therefore have never really been about to honestly contemplate a successful strategy for achieving victory in not only the Afghan theater but in the overall global conflict with radical Islamists.

Milton Friedman on Why Capitalism Works

Back in the 70s, free-trade economist Milton Friedman appeared on Phil Donahue’s show, Phil well-known for being an anti-American lover of communism, and schooled him on why capitalism was the best, the only, system for mankind’s betterment.

After the communist Donahue hectored Friedman on how rotten capitalism is, Friedman correctly said that, “the only cases in which the masses have escaped from the kind of grinding poverty you’re talking about, the only cases in recorded history are where they’ve had capitalism and largely free trade.”
