Irregularities in Skilled Healthcare Trial

-By Warner Todd Huston

Last month I wrote about the California healthcare case involving Skilled Healthcare LLC. The Nursing Home company was accused by trial lawyers of violating California’s regulations governing how many staff members per resident that is required to operate a healthcare facility and lost its case.

What struck me is that this case seemed to have been brought to court by trial lawyers and without actual victims or injury and, worse, the $671 million award could bankrupt the company putting thousands of elderly patients out on the street and eliminating hundreds of jobs.

Now there is an update on this case that takes it to a whole new level of craziness. Aside from the absurdity of the case in the first place, now it seems that there were all sorts of irregularities with the jury and the judge during the case.

Water—Great for Showers but not to Drink!

-By Don Boys, Ph.D.

I have plans to live to be 100 years old and live in good health! I may not make it but my plans include it. Of course, those plans could change if I get hit by a truck. In this column I provide some of the best information you can find to take care of your health and live a long life. (Of course, I must add that my training is not in the health field. You might want to check with your doctor. That statement will keep the Federal thugs off my back.)

What goes into the body will have an incredible effect on it, so we must be careful what we permit in the body. Since the body is the Temple of the Holy Spirit, it is a sin to mistreat it. Most educated people know the danger of sugar, some meats, chemicals, preservatives, etc., that can be detrimental to each of us. Today, I will deal with water, the most necessary item that goes into the body except oxygen.

Virginia Challenge of Obamacare Wins One in Court

-By Warner Todd Huston

U.S. District Judge Henry Hudson refused to dismiss Virginia’s lawsuit against Obamacare, today, allowing the suit against the federal government to continue on to the next stage.

The federal government sought a dismissal of the suit that challenges the Constitutionality of the part of Obamacare that requires every citizen to buy healthcare insurance.

In his report, Judge Hudson said:

The guiding precedent [on the Commerce Clause] is informative but inconclusive. Never before has the Commerce Clause and Necessary and Proper Clause been extended this far. At this juncture, the court is not persuaded that the Secretary has demonstrated a failure to state a cause of action with respect to the Commerce Clause element.

The chief claim of Virginia Attorney General Ken Cuccinelli is that the mandate to buy insurance violates the Commerce Clause of the Constitution. The federal government was attempting to have Virginia’s lawsuit thrown out with the claim that it doesn’t and should be thrown out because it is obvious that Obamacare does not violate the Constitution.

The judge, however, disagreed that it was so obvious and has allowed the suit to go forward.

It is Attorney General Cuccinelli’s contention that the insurance mandates expand federal power to never before seen heights of power in violation of the Constitution. It is an obvious conclusion, too.

New Chart Reveals the Impossible Complexity of Obamacare

-By Warner Todd Huston

The Republicans of the Joint Economic Committee have come out with a chart that shows the shocking and just plain idiotic complexity that is Obamacare. (Download .pdf file)

Four months after U.S. House Speaker Nancy Pelosi famously declared “We have to pass the bill so you can find out what’s in it,” a congressional panel has released the first chart illustrating the 2,801 page health care law President Obama signed into law in March.

Developed by the Joint Economic Committee minority, led by U.S Senator Sam Brownback of Kansas and Rep. Kevin Brady of Texas, the detailed organization chart displays a bewildering array of new government agencies, regulations and mandates.

Sadly, Obamacare is so complex that even this chart can only show about 1/3 of the foolishness involved. There is so much intertwined, serpentine connections that there was no physical way to even get it all on one chart.

Obama Forces Doctors to Snitch to Feds on Patient’s Weight

-By Warner Todd Huston

New federal regulations issued by Obama’s administration will require doctors to record their patient’s body mass index (BMI) ratio. No longer will your weight problems be a matter between you and your doctor. Thanks to Obama, now your doctor will be required by law to snitch to the feds on how fat you are.

Like most of what goes on in Washington, this new little regulation was stuck a bill otherwise wholly unconnected to healthcare, the stimulus billsection 301)

According to the government’s new HIT Standards (Health Information Technology), each patient’s BMI numbers will be recorded and must be available to the federal government on a national database exchange.

Obama’s FDR-Like Bait and Switch

-By Warner Todd Huston

Remember when Barack Hussein Obama first became president and the left-wing Old Media universally indulged the claim that he was “just like FDR“? Of late the Old Media has backed off that hyperbolic statement, but at least in a single incident, Obama has proven indeed to be just like FDR. The similarity entails laws about which the two presidents lied to the public in order to sell them. And in both instances, the truth only came out in court.

For FDR it was Social Security. The Roosevelt Administration sold Social Security as an “insurance” program when it began to push for the policy. The truth is, of course, that Social security and its unemployment plan adjunct is in no way an insurance program. It is welfare pure and simple.

But FDR sold it as “insurance” anyway. In 1936, for instance, FDR sternly told an audience in Pennsylvania that it was an insurance program.

Calif: Union Goons Start Pushing and Hitting Videographers

This is how “nurses” act? The kind, gentle folks of the California Nurses Association are seen in this video intimidating, pushing and knocking around some videographers at the union’s recent pro-Democrat rally in California.

Mike Griffing is the bearded fellow acting the thug at the end of the video. But he isn’t just some run-of-the-mill union tough. He’s the CNA’s Director of Collective Bargaining! That’s right, he’s an official of high status one that makes almost $164K a year, as Moe Lane found out.

If this is how officials of unions act… well, what does that say about their legitimacy?

Arizona Illegal Immigrant Law Fosters Wife Beating, or Something…

-By Warner Todd Huston

Want to hear the latest idiocy against the Arizona anti-illegal immigrant law dreamed up by open-border advocates and illegal alien supporters? Well, try this on for size: Arizona’s SB 1070 helps men beat their wives and girlfriends.

No, really. That is their argument.

A national organization called Legal Momentum has asked a federal court to block implementation of Arizona’s SB 1070 because they feel that immigrant women will be afraid to report abuse for fear of being deported.

Killers in White Coats: Physicians and Nurses Kill the Unwary!

-By Don Boys, Ph.D.

Today’s Distressing News: Medical people kill the unaware, the unarmed, and the unwilling! News reports reveal, “A high proportion of deaths classed as euthanasia in Belgium involved patients who did not ask for their lives to be ended, a study found. More than 100 nurses admitted to researchers that they had taken part in ‘terminations without request or consent.’” Exactly what we predicted if euthanasia became legal!

Euthanasia means “good or easy death,” but call it what it is–the right to kill the helpless, the innocent and the “useless.” It is a ploy to get rid of all the “useless eaters,” people who take up space on the earth and consume the resources. It is astounding that we are even discussing this issue at this time in our history. It indicates how uneducated, uncivilized, uncaring, and unthinking we are as a society. It also shows our lack of courage, for you will notice that these brave, bold, and brash killers are going after those who can’t fight back! But then, cowards have always done that!

Obama’s Healthcare Give Away to Union Special Interests

-By Warner Todd Huston

One of Obamacare’s new rules states that if your employer finds it necessary to change healthcare providers to a more cost effective plan they will lose their federal health plan exemptions. This will cause employers to drop employees from health plans forcing workers onto government sponsored plans. So much for Obama’s hoary idea that you can “keep your doctor if you like him.”

Of course, this harmful new rule only applies to 80 percent of America’s workforce because the other 20 percent, those that are union members, are getting a special deal from their pal Barack Obama.

At issue is the definition of the “grandfathered” health plan which is different for those plans initiated by collective bargaining and those simply instituted by an employer. The requirements for unions have been made far less stringent than those of non-union employers.

Ten ‘Marriage Values’ Policies to Rebuild America

-By David R. Usher and Michael J. McManus

Marriage-absence is the greatest domestic problem America faces. Our most daunting social, economic, budgetary, criminal, and constitutional dilemmas are driven by marriage-absence and will not abate unless traditional marriage is protected and encouraged.

Establishing sensible policies to return America to a marriage-based society will prove rewarding, productive, and seminal. The major problems of most unmarried mothers and their children will be naturally resolved. A woman’s right to be supported by, cared for, and helped by her husband will be ensured. Health care coverage will become commonplace without resorting to National Health Care. Chronic budgetary deficits at state levels will disappear and the federal deficit will drop as the number of single parent families costing taxpayers $20,000 each – plummets. (1) Most children will grow up in intact homes, disciplined and prepared to learn in school. Substance abuse, child abuse and neglect, and poverty will decrease to manageable norms. The dollar will regain strength as the currency of world exchange.

The future of the United States is in jeopardy. Therefore, we must re-create marriage in America now, while we still have time to prevent certain financial and social collapse.

Obamacare: Eliminating the Poor and Elderly’s Last Resort to Life and Health

-By Warner Todd Huston

Many left-wingers complain that our healthcare system as it stands leaves out the poor, elderly, and those least able to care for themselves. They say that because of this inequity private medical care should be eliminated and government should take over that role in society. That way, they claim, all will be treated equally and everyone will get the same sort of care. Unfortunately for this left-winger’s utopian fantasy, once government becomes the only doctor in town, the very poor, elderly and indigent about whom the left claims to care so much will end up forsaken by the very system envisioned to save their lives.

Does that seem counter-intuitive to you? Do you believe that those least able to take care of themselves will benefit from a government take over of healthcare in America? If so, you’ve been taken in, you’ve swallowed the left’s fantastic claims hook, line, and sinker and they are playing you for a fool… a fool with pockets to be picked clean and power to be taken away from.

In fact, we are already seeing Democrats and Obamacare advocates warming up the hearse to cart off the dead bodies of the young, indigent and elderly that will pile up as a result of lack of access to heatlhcare forced upon them by Obamacare.

Science of Gynecology Dictates no Abortions

-By Kevin Roeten

Few realize this, mostly because they were unborn at the time, but the exact opposite of Roe vs. Wade occurred in the late nineteenth century. The heinous act of abortion, whether done by poison, drug, or chemical, was commonplace until someone actually spoke up for the unborn. It occurred with a doctor called Horatio Storer, and the man willing to document his ventures, Frederick Dyer, did speak up.

Storer’s ground-breaking study and practice of gynecology was a first. Because gynecology was literally unknown in 1859, he was originally thought of as a ‘quack’. Public reluctance to discuss a crime that had existed for the last hundred years inhibited the push to eliminate induced abortion.

At that time, a ‘promoter’ of abortion was the huge advertising revenues paid to newspapers from abortionists and “abortion-drug” sellers. Profits for abortions were huge motivational tools for a few physicians, even though abortions were detested by almost all their other colleagues.

‘Party of the People’ Hides from Them

-By Warner Todd Huston

Remember those hoary days of yesteryear, those days when Democrats puffed themselves up as “the party of the people,” of that “party of the common man”? Flash forward to 2010 and we find that those stalwart homespun congressmen, born of the people have set a policy to avoid those “people,” the voters, at all costs. This summer break instead of coming home to visit with constituents and hearing them out at traditional townhall meetings that are usually held by members of Congress returning home, today’s Democrats are skulking into town quietly and once home refusing to hold such meetings where they can see their constituents.

So much for the “party of the common man,” eh?

In fact, Democrats have turned so cynical that Republicans are the ones having more townhalls than members of the majority governing party in Washington.

What are democrats doing instead of holding townhalls where they can hear from their constituents? They are having tightly controlled meetings where crowds are by invite only, they are holding events in constrained spaces where only a few voters can attend, or they are dealing only by phone-meetings where Democrats can use that “democratic” technology of the mute button! Even the New York Times has noticed that Democrats are in hiding.

National Healthcare Saves $$ By Letting Some Patients Suffer

-By Warner Todd Huston

Governor Sarah Palin once complained of those “death panels” in the President’s healthcare policy, a scoff that infuriated Obamacare’s supporters. But the fact is, by its very nature a nationalized healthcare system like the one that Obama wants acts as a “death panel” by denying care to save money. We don’t have to guess at this eventuality, either. We have but to look to England’s health services and we’ll see the exact situation that Palin warned about.

A recent piece published in the Daily Mail reports that the British National Health Service is going to deny services to millions of Britain’s citizens in order to save twenty billion pounds of the NHS budget. “Millions of patients face losing NHS care as bosses prepare to axe treatments to make £20billion of savings by 2014, a top doctor has warned,” the paper warns.

British medical services will likely soon deny hernia treatments, joint replacement for overweight patients, ear procedures (even for children), nose and eye operations, varicose vein procedures, gallbladder and also carpal tunnel procedures. And this isn’t something new. The Brits already deny all sorts of modern medicines because they feel the costs are too high.

It Simply Cannot Return to the Status Quo

-By Frank Salvato

If there is one thing that I have learned in my over 30-years of existing within the political realm it is that if the political world aligns to present the Republican Party with an opportunity to advance on Liberal Democrats and Progressives in government, somehow, someway, they always manage to find a way to shoot themselves in the foot. This point in history is no exception.

During the last election cycle, Republicans railed against the Democrats about earmarks, special interest spending and fiscal irresponsibility. Many rolled their eyes in amusement citing the fiscal irresponsibility of the Republican controlled Congress dating back to approximately 2000, just after the “Republican Revolution.” Yet close to half the electorate recognized that a fiscally debauched decade of Republican spending wasn’t comparable to the steady and consistent tax-and-spend policies of the Democrat Party dating back to before the turn of the 20th Century.

Democrats – and Progressives masquerading as Democrats – were forced to feign frugality where their platform was concerned and slightly more than half the electorate ate-up the media spoon-fed “hope and change” canard, thus empowering the most Progressive Executive and Legislative Branches in recent US history.

The barbaric Muslim practice of mutilating the genitals of little girls apparently is A’OK with the American Academy of Pediatrics, at least just a little bit, anyway. In an act of political correctness gone mad the AAP has announced that it thinks it’s a good idea to mollify Muslims and gloss over their barbaric practice by instituting what they are calling a “ritual nick” on little girl’s genitals.

It’s the veritable camel’s nose under the tent flaps. After all, by what logic does one refuse to accept this disgusting attack on womanhood when you agree that any part of the practice is justifiable? Today it will be a “ritual nick,” then it becomes a “ceremonial slash,” graduating to excuse the removal of some ever growing amount of flesh, and before you know it we have full-blown mutilation of little girls just like many Muslims want.

The Legend of the “ER Freeloader”

– Richard J. Little

Yes, uncompensated medical care is a problem but it’s not as big as conventional wisdom leads us to believe. “Big government” may be a villain to the conservative Republicans and the “evil insurance” company may be the object of hatred by liberal Democrats. But the “ER freeloader” is unique in that he is despised by both sides of the Obamacare debate. Liberal democrats constantly attack the “ER freeloader” without mercy and relentlessly cite uncompensated care as justification for the individual mandate. Supposedly, the individual mandate will supposedly use government force to bear to “make the irresponsible freeloaders” pay their own medical bills.

However, what is missing from this narrative is the true cost of uncompensated care. Or more importantly, what is also missing is any information on the true costs of the Obamacare solution.

As it turns out, the data need to answer what the real cost of “ER Freeloading” has been publicly available for quite a while in a document that both sides of the Obamacare debate consider to be an unbiased and accurate source of information on the cost of uncompensated care: the Kaiser Family Foundation’s 2008 study on the Uninsured in America (.PDF File).

The fact that this legislation contains more than $500 Billion in Medicare cuts is a PERFECT example of government bureaucrats INTERFERING with doctor and patient decisions. The 21% reduction in payments to physicians who accept Medicare will most certainly guarantee less doctors accepting Medicare. This will have a DIRECT affect on both the quality of care that our seniors enjoy now and the ABILITY to even OBTAIN care. Add to that the SWEEPING powers given to the Secretary of Health & Human Services, Kathleen Sebelius (an ATTORNEY NOT A PHYSICIAN) and we are GUARANTEED to see a reduction in services based on cost.

Summoning Our Inner Hero

– By Jeff Lukens

Rarely does the concern of the middle-class reach a point where they start protesting the government en masse. The passage of ObamaCare and the impending financial ruin of our country is now one of those times.

Despite immense opposition, Barack Obama and the Democrats in Congress forced through a health care bill, not to improve people’s health care but to expand the power of the state over them. It is the height of arrogance. As ObamaCare moves closer to reality, we know the resulting intrusion of government in our lives will not allow us to continue to live as we have before.

We know the government can’t keep running huge deficits and think there will be no consequences. We know the federal and many state budgets are already broke, and that hard times are coming. We know that Obama is deliberately trying to drive the country off a cliff with debt our grandchildren can never repay. And we know that when we speak out against this madness, they will malign us and likely smear us as racists.

“Taxpayer expect accountability. Health Insurance reform is as important to America’s fiscal health as it is to our physical health. Currently the U.S. spends twice as much, as a percentage of GDP, than other industrialized nations on health care, while an estimated 45 million people are uncovered. At a time when our nation’s debt exceeds $12 trillion, H.R. 3950 provides the most significant deficit reduction in more than a decade. According to the non-partisan Congressional Budget Office, this bill cuts our federal deficit by $1.3 trillion over 20 years…”

Firstly, we know of no economist, actuary or accountant in the private sector that would ever attempt to score the cost of a piece of legislation (certainly one of this size) out over a 20 year period and we’ve already exposed the “fuzzy math” used by this administration to hide the REAL cost of this legislation. President Harry Truman’s famous words apply perfectly to the scoring of this legislation. He said : “Those who do not know history are doomed to repeat it. In 1965 the Fed projected that costs for Medicare Part A would be $9 Billion. It ended up costing $67 BILLION! The Medicaid special hospital subsidy was supposed to cost $100 MILLION. Instead the real cost was $11 BILLION! That’s ONE HUNDRED TIMES GREATER!
