A Native American woman who knocked a white woman unconscious while screaming “I hate white people” did not commit a racially motivated “hate crime,” a judge ruled in a recent case. But if this isn’t a hate crime… what IS?
Judge Harry Van Harten of the Alberta Provincial Court in Calgary, Canada, claimed in a July ruling that he did not see enough proof that assailant Tamara Crowchief was motivated by race hate when she launched an unprovoked, sneak attack on victim Lydia White in November.
The judge made his ruling despite testimony that Crowchief yelled “I hate white people” during her attack. The ruling was also despite evidence that during her arrest Crowchief told officers that, “the white man was out to get her.”
But Judge Van Harten insisted that wasn’t enough “evidence” to prove racist intent.
“There is no evidence either way about what the offender meant or whether … she holds or promotes an ideology which would explain why this assault was aimed at this victim,” the judge said in his ruling.
“I am not satisfied beyond a reasonable doubt that this offense was, even in part, motivated by racial bias,” Judge Van Harten added.
According to police Crowchief walked up to the victim outside a bar and without warning punched her in the face. The punch was so hard the victim’s tooth was knocked out.
“I don’t understand why this woman did this. I never did anything to her. Never even spoke to her,” the victim said.
Judge Van Harten also ruled that the perpetrator had already spent enough time in jail waiting for the final trial was time enough spent in jail for the attack. Still, Crowchief was sentenced to 12 months probation. She also was ordered to get psychological and psychiatric counseling, as well as counseling for substance abuse.
So, we have an Indian woman violently attacking a white woman she does not know while yelling that she hates whites. Then she tells the police all whites are out to get her…. And yet this judge sees no reason to say her attack was based on her hatred for whites?
If this wasn’t a hate crime then nothing can be.
